		<description>I got a health professions loan given by the university.  I transferred out of the college to change my major.  I let it get to default and now it is in collections ($23,000).  the collection agency contacted me saying that i can sign up for a loan consolidation, but the problem is the federal loans says that i need to be out of school. i am still in school. therefore i need to pay the 23,000.  they said there is no other way. even if i set up a payment plan, all my finanical aid gets revoked.  what do i do???????????</description>

		<description>I have sued 3 collections agencies and won 3 times, so let&#039;s dance if you have the balls, which I believe you are castrated.

This has everything to do of been a person, regardless of your idiotic comments.

Don&#039;t let this scum tell you otherwise.

IF they know where you live, and they call you all the time. You have various options.

1: You can send them a stop and desist letter, this will stop the calls (send the letter certified, that way they need to sign and you will have a copy)  if they do not stop the calls, report them to your local district attorney. This is a federal law and is not going around it. 

Remember majority of this unpaid loans are insured and the original creditor takes it out of their books as a loss.

2: They have the burden of proof, they must bring all documents that you signed to court, if they do not and you show and fight back, you have a huge chance to win, then you can file for fraud and intent of commit fraud, if they are not in your state and they try to sue then that becomes a federal crime as interstate fraud is a federal crime.
They must serve you if they want to sue, they by law need to sue you directly, many of this scan bags, will leave the documents anywhere with no proof and the court takes that as a delivery, so the next step for all of you is to pressure the government to change the law and have then delivery the documents where the party been served signs the documents like any other country.
If you are served, go to court and be prepared, I do recommend you at that time to bring an attorney, get an experience attorney, majority of the cases will be thrown out of court.

3: Some states will authorize the collections attorney to put and add on the paper to server you; this must be authorized by the court, example California. This is rare and not often used.

The problem you now face is that this scum bags will sell the paper to one to another even if you have paid and will need to defend yourself, time and time again, so you must bring the documents of your previous court case to prove this fact.
Many of this scum bags as well try to collect multiple time on the same loan even if it has been paid, so not do that, if not you will be stuck the rest of your life.

4: I recommend you to find out the status of limitation of your state, as this people can only sue in a specific period of time, from the date you made your last payment, not after that. Keep all records. Each state is different.

5: record all calls that you receive, try to add a answering machine in which you can add tapes, the courts do not accept digital recordings. 
Also if you speak to them, record every single conversation, you can buy the little gadget at Radio shack for a few dollars, many of this people have lost as well their cases on court for abusive behavior and threats, which is against the law, then you can sue them as well.

6: No they cannot take you to jail, no they cannot go after your family that is law 101, also they legally cannot call your workplace, they may want to server you there to embarrass you.  Now you have another option, you can sue them at that time, for emotional distress, been fired from your work ETC. Talk to an attorney on your city about this.

My last recommendation is learn more before you let them intimidate you. When you do research be aware that majority of comments that are pseudo positive about this, they have been written by the scam bugs their self&#039;s. Go online, go to the library, talk to an attorney more if you have a friend that is in law, and ask them about your option, they also have some cheap, legal help offices that can guide you.

But last, do not let them intimidated you that is what they want, if you want to negotiate do not do so, request them to send you all documents and they must have the ones with your original signature, if they do not, they already lost.

Remember always record any and all conversation, that is a legal proof, any small recorder will do (Use tape not digital), go to radio shack and buy the small gadget to connect to your phone and to the small recorder (buy one that is voice activated), never let them abuse you over the phone or make treats, record them and go to your local district attorney.

Learn to fight back and protect yourself, if you have paid already and they contact you again to pay, go to your district attorney and file and accuse them of fraud.

I hope this helps all of you, we will be posting address and phone numbers of all the companies&#039; employees, lets harass them as well.

They just send a letter with a bootom amount on it with NO other descriptive information (other than the name of the institution; no accounting, lists of classes, dates of attendance, etc.). ...and on, and on, and on.

Haven&#039;t seen my question addressed, though, so here goes. Last year, just after parting ways with my rip-off health insurer (Kaiser), my appendix decided to burst. It happened on the 4th of July, just 3 1/2 months after losing my insurance. I was taken to an emergency room and given care. Since then I&#039;ve been bombarded with bills and calls from about 7 different companies -- paramedics, radiology, the hospital, the surgeon, etc. I haven&#039;t answered any of them or paid a cent. Simply couldn&#039;t. Still can&#039;t.

I&#039;m in California. I understand that any of these agencies could decide to sue me before the SoL is up. I&#039;m concerned about that, but after reading all the advise and experiences here, I think I can handle it. Here&#039;s what I&#039;m most worried about...

Several years ago I was &quot;gifted&quot; with a sixth of an inheritance that my mom got from her dad. It was in the form of mutual funds. I have never touched these funds and they seem to have weathered the economic melt-down pretty well. They are all I have for &quot;retirement,&quot; since I&#039;ve never had the kinds of jobs that would allow me to save much. I consider the mutual funds like my own personal retirement fund, that I&#039;ll never touch til then, not even for a rainy day.

I won&#039;t use these funds to pay off my debt of nearly $50,000 (from the appendicitis). However, I&#039;m scared that &quot;they&quot; can seize my funds somehow. I have nothing worth taking in my bank account. But if those mutual funds were taken, I&#039;d be devastated. Is there a way to know if they can take my mutual funds? How would they even know I own them -- do I have to admit it if we go to court? Can I protect them somehow (besides withdrawing them and hiding the money in my mattress!)?

Any advice you can offer about their right to seize property/assets in California would be hugely appreciated! I&#039;m a nervous wreck about this. The mutual funds have been the only bright spot monetarily in a life of financial hardship. If I lost them...

		<description>Great article. I have been contacted about my student loans from scam artists DCS. The original lender was unwilling to work with me after I sent numerous letters ~ they never responded. When I finally had a chance to call they stated they don&#039;t write letters back. My response was I work the same hours they do and it was unethical for me to call during my own business hours. So, DCS calls my work, threatens to garnish my wages unless I begin paying. So, scared out of my wits, I have made 1 payment which left me broke and does not leave enough money for me and my son (yep, I am a single mom with no help or child support). Can I still write the letter above and request verification even though I&#039;ve made 1 payment? Also, the payment was a money order because they couldn&#039;t withdraw from my checking account. Your insight is most helpful.</description>
